1. Introduction
This “Privacy Policy” governs your use of the Kina Rewards Inc (“Kina” or “Company” or “we” or “us”) websites and all features, tools, content, downloads, and other services (“Services”) that we make available through those websites (collectively, referred to herein as the “Platform”).
If we notify you of a different privacy policy for a different service, this Privacy Policy will not apply. This Privacy Policy also does not apply to information collected by us offline or collected by any third party, including through any application or content (including advertising) that may link to or be accessible from our websites. By using our Platform you consent to our Privacy Policy and our collection, use, and sharing of your information and data, and other activities, as described below. If you disagree to be bound by those terms, you are not authorized to access or use the Platform, and you must promptly exit the Platform. If we make any changes to our Privacy Policy, we will post the revised Privacy Policy and update the "Last updated" date of the Privacy Policy.
Our Services are intended for use by adults, including parents and legal guardians. Although our Services may relate to children and family activities, we do not knowingly collect personal information directly from children under the age of 13. Individuals under the age of 18 should not create an account or use the Services except where permitted by applicable law and with appropriate parental or legal guardian authorization. If we become aware that we have inadvertently collected personal information directly from a child under the age of 13, we will promptly delete such information.
1.2 Information covered by this Privacy Policy. For purposes of this Privacy Policy, our use of the term “information” means any and all information we receive from or about you. Information is divided into two distinct categories:
“Non-Personal Information” means Information that does not personally identify a person.
“Personal Information” means information related to a natural person that can be used to directly or indirectly identify the person, such as names, addresses, e-mail addresses, and phone numbers, as well as other non-public information that is associated with the foregoing.
2. Acceptance of Terms
2.1 We obtain and use information in accordance with this Privacy Policy. We will ask for your consent before using Personal Information in a manner other than as set out in this Privacy Policy.
2.2 BY USING OUR SERVICES OR VISITING OUR SITE OR SUBMITTING INFORMATION THROUGH THE SERVICES OR VIA OUR SITE, YOU EXPRESSLY CONSENT TO THE COLLECTION, PROCESSING, AND USE OF YOUR INFORMATION IN ACCORDANCE WITH THIS PRIVACY POLICY, INCLUDING THE COLLECTION, USE, DISCLOSURE, STORAGE, TRANSFER AND PROCESSING OF YOUR INFORMATION, INCLUDING YOUR PERSONAL INFORMATION, AS DESCRIBED HEREIN.

3. Information We Collect and How We Collect It
3.1 Information You Provide. We collect Personal Information that you provide to us when you create or update your Kina account, use our Services, participate in the Kina Rewards Program, book or manage an Expert Session, request assistance from Kina Concierge, submit information to verify your identity, contact us with questions or feedback, participate in a survey, promotion, or research program, or otherwise communicate with us.
If you choose to create a child profile, you may provide information about your child, such as their name, year of birth, school, and other information you choose to add. Child profiles are optional.
We use this information to personalize and support your experience with Kina, including organizing information about your family, providing age- or school-relevant recommendations and insights where available, assisting with Expert Sessions or Kina Concierge requests, and enabling other family-related features and services that you choose to use. Not all child profile information will necessarily be used by every feature of the Services.
We collect this information from you as the parent or legal guardian, or from another person authorized to provide it, and not directly from the child.
Depending on the Services you use, this information may include your name, mailing address, location information, email address, phone number, payment information, financial information, family or household information, preferences, interests, and information you provide about the type of assistance, Expert, product, service, or provider you are seeking.
When you request an Expert Session or assistance from Kina Concierge, you may choose to provide information relevant to your request. Depending on the nature of your request, this information could include information relating to you or your family that may be considered sensitive under applicable law. Please provide only information that is reasonably necessary for the service or assistance you are requesting.
If you use features of the Platform that allow you to share User Content or other information with other users or third parties, the persons with whom you choose to share that information may have access to it.
3.2 Information Related to Expert Sessions and Concierge Services
When you book or participate in an Expert Session, we may collect information necessary to facilitate and administer the session, such as the Expert selected, session type, date and time, booking status, and information you choose to provide in connection with your booking.
Information you communicate directly to an Expert during an Expert Session may be collected or maintained by the Expert and may be subject to the Expert’s own privacy, confidentiality, professional, or recordkeeping obligations. Kina does not require Experts to provide us with their professional or clinical notes or records from your Expert Session.
If you request assistance from Kina Concierge following an Expert Session, or otherwise authorize an Expert to facilitate a handoff to Kina Concierge, we may receive limited information about the type of assistance you are seeking. We ask Experts to limit information shared with Kina to what is reasonably necessary to facilitate the assistance you requested.
Kina Concierge may also collect information you choose to provide to help us identify or coordinate products, services, or providers that may be appropriate for your request, such as your preferences, location, availability, budget, insurance preferences, or other relevant criteria.
Depending on the nature of your request, information you choose to provide to Kina Concierge may be considered sensitive Personal Information under applicable law. We use and disclose such information as described in this Privacy Policy and in accordance with applicable law.
3.3 Your Email or Social Network Contacts. We collect your email, social network, and other contacts (“Contacts”) if you choose to share them with us, or if you choose to refer potential customers to us via our referral programs (the “Referred Leads”).
3.4 Public Information. We may collect information about you from public sources, such as public social media pages.
3.5 Information from Third Parties. We may collect information about you, including personal information and financial account information, from third parties, such as financial institutions and our service providers, for purposes of identity verification, fraud protection, risk assessment, and other purposes. We may collect your business information from credit bureaus for the foregoing purposes as well. We may also collect information about you from other users naming you as a Referred Lead or from users requesting that you be added to the Services as a “worker”. In addition, we may receive demographic information about you from third parties to help us better understand our users and to improve and market our Services.
3.6 Automatically Collected Information. As is true with most service providers, we may automatically collect certain usage information when you access the Site or use the Services, such as your device identifier (if using a mobile device), Internet Protocol (IP) address (if using a browser), operating system, browser type and version, time zone setting, Internet service provider (ISP), referring and exit websites and applications, and clickstream data. We use this information to understand and analyze trends, to administer the Site, to learn about user behavior on the Site, to improve our products and services, and to gather demographic information about our users. We may also use this information in our marketing and advertising services. We also automatically collect certain usage information through cookies and related technologies, as described in Section 3.7 below. In addition, our Site may implement third-party software, such as Google’s Invisible reCAPTCHA, that collects your information for security purposes.
3.7 Single Sign-On Information. We may allow you to create an account or sign in to the Services using an account you maintain with a third-party service, such as Google, Apple, or another supported provider. If you choose to use a third-party sign-in service, we may receive certain information from that provider, such as your name, email address, account identifier, profile information, or other information you authorize the provider to share with us.
We do not receive or store the password you use to access your account with the third-party provider. The information we receive depends on the provider, your settings with that provider, and the permissions you grant.
3.8 Cookies and Other Related Technologies.
3.8.1 Cookies are small pieces of text placed on your browser by websites that you visit. When you use or access the Site, we may place a number of cookies files in your web browser, which allow the Site to recognize you, to make the website function properly, and to collect data about you and your usage, as well as to provide business and marketing information to us. By using or accessing our Site, you agree that we may use, store, and access cookies on and from your computer or other device and that we may use additional methods to collect website usage data and IP addresses.
3.8.2 We may use cookies, pixel tags, web beacons and other similar technologies to remember your preferences and settings, better understand user behavior, reveal which areas of the Site users have visited, facilitate and measure the effectiveness of advertisements and web searches, monitor aggregate usage by our users, and monitor web traffic routing on our Site to help us improve our Site. When you re-visit our Site, cookies allow the Site to recognize you, remember your preferences, and tailor your use of the Site. Information provided by cookies can help us to analyse your use of our Site and help us to provide you with a better user experience.
3.8.3 Pixel tags enable email messages in a format that customers can read, and they indicate whether email has been opened. We may also use this information to reduce or eliminate messages sent to you.
3.8.4 Most Internet browsers let you change the browser’s settings to stop accepting cookies or to prompt you before accepting a cookie from websites you visit. For more information on how to manage cookies, visit your browser’s help pages. If you do not allow cookies, you may not be able to use some or all portions or functionality of the Site or Services. Please note that if you change computers or web browsers, you will need to disable cookies once again.
3.9 Third Parties. We may work with third-party analytics, advertising, and marketing partners to help us understand how users interact with our Site and Services, measure the effectiveness of our marketing and advertising campaigns, attribute visits or sign-ups to particular campaigns or sources, and improve our marketing efforts.
These partners may use cookies, pixels, web beacons, device identifiers, and similar technologies to collect information about your interactions with our Site and Services. Depending on the technologies we use and applicable law, certain disclosures of Personal Information to advertising or marketing partners may be considered a “sale” or “sharing” of Personal Information even if Kina does not receive monetary payment for the information.
Where required by applicable law, we will provide users with applicable choices or mechanisms to opt out of such uses or disclosures.
3.10 Financial Account Connections (Plaid)
We use Plaid Technologies, Inc. ("Plaid") to enable you to securely connect your financial accounts to our Services.
When you choose to connect a financial account through Plaid, you authorize Plaid to collect, access, and transmit your financial account information on our behalf. The information Plaid provides to us may include account identifiers, balances, transaction history, account ownership information, and other financial information necessary to provide our Services.
Your use of Plaid is subject to Plaid's End User Privacy Policy, available at https://plaid.com/legal/#end-user-privacy-policy. By connecting your financial account through Plaid, you acknowledge that your information will be collected, processed, transferred, and stored by Plaid in accordance with its privacy policy.
We do not receive or store your online banking credentials. Your login credentials are collected and processed directly by Plaid through its secure interface.
3.11 Sensitive Personal Information
Depending on the Services you use and the information you choose to provide, Kina may collect certain information that is considered sensitive Personal Information under applicable law. This may include financial information and information you voluntarily provide in connection with an Expert Session, Kina Concierge request, or request for a particular provider or service.
We collect and use sensitive Personal Information only as reasonably necessary to provide, operate, support, and improve the Services you request; facilitate authorized Expert Sessions, Concierge assistance, referrals, or introductions; protect the security and integrity of our Services; comply with applicable law; and for other purposes permitted by applicable law.
We do not require you to provide Kina with professional or clinical records, therapy notes, medical records, diagnoses, or similarly sensitive records in order to use Kina Concierge unless such information is reasonably necessary for a service you specifically request and we provide an appropriate method for collecting it.
Please do not provide sensitive Personal Information that is not reasonably necessary for the Service you are requesting.
4. Use of Your Information
4.1 We use information that we collect about you for the following purposes:
to administer the Site, manage accounts and provide the Services;
to monitor, analyze, improve and develop content, advertising and the Site and Services, and to create new features of the Services;
to provide a more customized experience on the Site, Services and/or our partners’ or affiliates’ websites;
to verify identity and determine appropriate services;
to understand our users better;
to validate user information provided to us for fraud and risk detection purposes;
to determine eligibility for the Services;
for internal purposes such as auditing, data analysis, and research;
to prevent, identify and address fraudulent or other illegal activity and security issues;
to (i) solicit feedback, (ii) respond to your comments, requests or inquiries, (iii) provide customer service and support, or (iv) otherwise contact you in connection with the Site or Services;
to generate anonymized, aggregate data containing only de-identified, non-personal information that we may use to publish reports;
for our marketing purposes, such as (i) informing you of our or our partners’ or affiliates’ products, services, features or offerings that may be of interest to you, (ii) providing you with newsletters, articles, reports, updates and announcements, as well as information about upcoming events, (iii) contacting Referred Leads and suggesting Contacts for you to refer to Kina, (iv) improving and tailoring our advertising and communications, (v) analyzing our marketing efforts, and (vi) determining your eligibility for certain marketing programs, events and offers. If you prefer to be removed from our mailing list, you can opt-out at any time by updating your preferences in your account or contacting us at hello@kina.co;
to operate our business, which includes, without limitation, using your information (i) to process payments, (ii) to send important notices, such as communications regarding the Site and Services, and changes to our terms and policies; (iii) to manage and enforce contracts with you or with third parties, (iv) to manage our corporate governance, compliance and auditing practices, and (v) for recruitment purposes, if you submit an application for employment with Kina via the Site;
to administer any sweepstakes, contests, or similar promotions you may enter;
in the case of non-personal information (which includes, without limitation, zip code, area code, unique device identifier, referrer URL, location, and the time zone), we may collect, use, transfer, and disclose non-personal information for any purpose;
to (i) comply with laws, rules and regulations, including any disclosure or reporting obligations, (ii) resolve disputes with users or third parties, (iii) respond to claims and legal process (including but not limited to subpoenas and court orders) as we deem necessary or appropriate, (iv) protect our property rights or those of third parties, (v) protect the safety of the public or any person, and (vi) prevent or stop any activity which we may consider to be (or to pose a risk of being) illegal, unethical or legally actionable; and
for any other purpose for which you expressly authorize us to use your information.
We may use your phone number to send transactional or service-related SMS messages in accordance with your preferences and applicable law.
4.2 We may also use Personal Information to:
Facilitate, schedule, administer, and support Expert Sessions;
Provide Kina Concierge services, including understanding your request, researching and identifying potential providers, products, or services, facilitating introductions, and assisting with coordination or scheduling;
Personalize Expert, provider, service, benefit, or other recommendations based on information and preferences you choose to provide;
Communicate with you about Expert Sessions, Concierge requests, referrals, introductions, bookings, and related services;
Facilitate information sharing that you request or authorize between you, an Expert, Kina Concierge, and a Third-Party Provider;
Verify eligibility for, administer, and improve Kina membership benefits, Expert Sessions, Concierge services, and other features of the Platform;
Evaluate the quality and effectiveness of our Expert Network, Concierge services, partner network, and member experience, including through feedback and service-related analytics; and
Facilitate referrals, introductions, bookings, or transactions with Third-Party Providers and administer related partner relationships, including tracking compensation that Kina may receive in connection with eligible referrals, bookings, purchases, or services.
5. Disclosure to Third Parties
5.1 We will share your information only with the third parties listed below for the purposes described above in Section 4 - “Use of Your Information”:
government agencies and taxing authorities, as required to provide the Services, including but not limited to the Internal Revenue Service and state and local tax agencies; banking and financial institutions;
certain parties as necessary to respond in good faith to legal process (including but not limited to subpoenas and court orders);
legal and financial advisors and auditors;
third-party agents, partners and service providers, these service providers may include cloud hosting providers, identity verification providers, customer support providers, communications providers, analytics providers, payment processors, infrastructure providers, and other vendors that help us operate and improve our Services who (i) are only permitted to use your information as we allow (which may include contacting you on our behalf), and (ii) are required under law or contract to keep your personal information confidential. This excludes SMS opt-in data and consent, which is never shared with third parties for marketing or promotional purposes; and the following third parties under the circumstances described below:
we may share business information with credit bureaus, and we may share information with certain companies, banks and organizations for the purposes of fraud prevention and determining eligibility for the Services;
if you participate in our referral programs and/or share your Contacts with us and invite them to join Kina, the referral emails sent to your Contacts and Referred Leads will include your name and the fact that you are a Kinauser;
if there is a sale of all or a portion of the Kina business (including, without limitation, a merger, stock acquisition, sale of assets or reorganization), or in the event that Kina liquidates or dissolves, we may sell, transfer or otherwise share some or all of our assets, which could include your information, to the acquirer;
from time to time, we may share reports with the public that contain anonymized, aggregate, de-identified information and statistics;
we may share your information with certain other third parties with whom you expressly authorize us to share your information; and
we may disclose information about you if we determine that for purposes of national security, law enforcement or other issues of public importance, disclosure is necessary or appropriate. We may also disclose information about you, but only where there is a lawful basis for doing so, if we determine that disclosure is reasonably necessary to enforce our terms and conditions or protect our operations or users.
5.2 We do not share information with third parties for their own direct marketing purposes.
5.3 SMS Communications & Mobile Data
If you consent to receive SMS messages from Kina, you agree to receive transactional, service-related, or promotional messages related to your account, activities, or services.
Message frequency may vary. Message and data rates may apply. You can opt out at any time by replying STOP, or request assistance by replying HELP.
We do not share, sell, or rent your mobile number or SMS opt-in data with third parties for marketing or promotional purposes.
Text messaging originator opt-in data and consent will not be shared with any third parties, except for vendors and service providers who support the delivery of our messaging services (such as messaging platforms, carriers, and infrastructure providers).
5.4 Experts and Third-Party Providers
We may share Personal Information with Experts and Third-Party Providers when reasonably necessary to provide Services you request or authorize.
When you book an Expert Session, we may share information with the Expert that is reasonably necessary to facilitate the session, such as your name, scheduling information, the type of session booked, and information you choose to provide in connection with your booking.
If you request assistance from Kina Concierge or authorize an Expert to facilitate a Concierge handoff, we may share limited information with potential Third-Party Providers when reasonably necessary to research availability, determine whether a provider may be appropriate for your request, facilitate an introduction, or coordinate a service. Where appropriate, we may ask for your additional authorization before sharing information with a Third-Party Provider.
We do not require Experts to share their professional or clinical notes or records from an Expert Session with Kina, and we do not disclose the contents of your communications with an Expert to Third-Party Providers unless you request or authorize the disclosure or it is otherwise permitted or required by law.
Third-Party Providers may collect Personal Information directly from you and may process that information under their own privacy policies, professional obligations, and applicable laws. We encourage you to review the privacy practices of a Third-Party Provider before providing information directly to that provider.
6. Protection of Personal Information
6.1 We take the security of your personal information very seriously. We take reasonable administrative, technical, and physical safeguards designed to protect the confidentiality, integrity, and availability of personal information. Information transmitted between your device and our Services is encrypted using Transport Layer Security (TLS). Sensitive data stored by us or our cloud service providers is encrypted at rest where appropriate. Access to personal information is restricted to authorized personnel based on business need and is subject to appropriate authentication and access controls.In the event of a security incident involving personal information, we will investigate the incident promptly and provide any required notifications in accordance with applicable law.
6.2 While no method of electronic transmission over the Internet or method of electronic storage is completely secure, we continuously maintain and update reasonable administrative, technical, and physical safeguards designed to protect the personal information we collect. Although we strive to protect your personal information, we cannot guarantee its absolute security.
6.3 We limit access to personal information to employees, contractors, and service providers who require such access to perform their job responsibilities and who are subject to appropriate confidentiality obligations.
6.4 When using the Site or Services, you may be provided the opportunity to post in a forum or chat room. Should you choose to do so, note that the personal information and content you share is visible to other users and can be read, collected or used by them. You are responsible for the personal information you choose to communicate in these instances.
7. Access to Your Personal Information
You may review, update, correct or delete your personal information through your account or by contacting us using the contact information listed below. We will provide you with access to your personal information for any purpose, including to request that we correct the data if it is inaccurate or delete the data if we are not required to retain it by law or for legitimate business purposes. If you would like us to delete your account entirely, please contact us at hello@kina.co with a request that we delete your account and personal information. We may retain some of your personal information as necessary to comply with our legal obligations, resolve disputes, enforce our agreements, or as needed for other legitimate business purposes.
Additionally, we may decline to process requests that are frivolous/vexatious, jeopardize the privacy of others, are extremely impractical, or for which access is not otherwise required by applicable law. We may also decline aspects of deletion or access requests if we believe doing so would undermine our legitimate use of data for anti-fraud and security purposes as previously described.
8. Retention of Personal Information
We will retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Policy. When evaluating these periods, we carefully examine our need to collect personal information and, if we establish a need, we only retain it for the shortest period necessary to fulfill the purpose of collection, unless a longer retention period is required or permitted by applicable law.
We retain personal and financial information only for as long as necessary to provide our Services, comply with applicable legal and regulatory obligations, resolve disputes, enforce our agreements, and protect against fraud and abuse. When personal information is no longer required, we securely delete, anonymize, or otherwise dispose of it in accordance with our data retention and information security practices.
Information associated with Expert Sessions and Kina Concierge requests may be retained for as long as reasonably necessary to facilitate and administer the requested Services, maintain appropriate business and transaction records, resolve disputes, protect against fraud or misuse, comply with our legal obligations, and otherwise fulfill the purposes described in this Privacy Policy. Professional or clinical records independently created or maintained by an Expert are subject to that Expert’s own retention obligations and are not controlled by Kina.
9. Legal Bases for Our Use of Your Personal Information
9.1 We rely on both your consent and our legitimate business interests as the legal bases for processing Personal Information. In this regard, we use your Personal Information when necessary (a) to perform our obligations under any contract with you; (b) to comply with our legal obligations (for example, complying with our legal and regulatory obligations); and (c) for our legitimate interests or the legitimate interests of others (for example, to ensure the security of our Site or Services). If we rely on our (or another person's) legitimate interests for using your Personal Information, we will undertake a balancing test to ensure that our (or the other person's) legitimate interests are not outweighed by your interests or fundamental rights and freedoms which require protection of the Personal Information.
9.2 If we rely on your consent for us to use your Personal Information in a particular way, but you later change your mind, you may withdraw your consent by contacting us at the e-mail address set forth in the “Contact Us” section below, and we will stop doing so.
9.3 Your information may be processed and stored in the United States or other jurisdictions where our service providers operate. By using our Services, you understand that your information may be transferred to countries whose data protection laws may differ from those of your jurisdiction.
10. Links to Other Sites
The Platform and Services may contain links to, integrate with, or facilitate access to third-party websites, products, services, Experts, and Third-Party Providers. Third parties may collect Personal Information directly from you in connection with their products or services, and their collection, use, disclosure, and protection of that information is governed by their own privacy policies, terms, professional obligations, and applicable laws.
This Privacy Policy applies to Personal Information collected and processed by Kina and does not govern the independent privacy practices of third parties. We encourage you to review the applicable privacy policies and terms before providing Personal Information directly to a third party.
11. Notice for Minors
11.1 Kina’s Services are intended for adults and are not directed to children under the age of 13. We do not knowingly collect Personal Information directly from children under the age of 13 without appropriate authorization or as otherwise permitted by applicable law. Individuals under the age of 18 should not create an account or use the Services except where permitted by applicable law and with appropriate parental or legal guardian authorization. If we become aware that we have collected Personal Information directly from a child under the age of 13 in a manner not permitted by applicable law, we will take reasonable steps to delete such information.
11.2 Because Kina provides Services designed to support parents and families, a parent or legal guardian may choose to provide information about their child in connection with an Expert Session, Kina Concierge request, rewards benefit, or other Service. This may include information such as a child’s age, interests, activities, educational needs, preferences, or other information reasonably relevant to the Service being requested.
When providing information about a child, you represent that you are the child’s parent or legal guardian, or otherwise have the authority to provide the information for the applicable purpose. Please provide only information about a child that is reasonably necessary for the Service you are requesting.
Information about children provided by parents or legal guardians will be collected, used, disclosed, and retained as described in this Privacy Policy and in accordance with applicable law.
11.3 Minors, or their legal guardians where applicable, may request access to, correction of, or removal of Personal Information they have provided to Kina by contacting us at hello@kina.co. We will process such requests in accordance with applicable law. Removal may not result in complete deletion where Kina is legally permitted or required to retain certain information.
12. Your California Privacy Rights
12.1 Under California Civil Code Section 1798.83, California residents are entitled once per year to request certain information regarding our disclosure, if any, of personal information to third parties for their direct marketing purposes during the preceding calendar year. We do not share our customers’ personal information with third parties for their own direct marketing purposes. California residents may request further information about our compliance with this law by sending a request to the address set forth in the Contact Information section below. You must include “California Privacy Rights” in the subject line, and your full name, email address, and postal address in your request. We will be happy to respond to your request.
12.2 If you are a California resident under the age of 18 and a registered user, you can request that we remove content or information that you have posted to our Site or Services. Note that fulfillment of the request may not ensure complete or comprehensive removal (e.g., if the content or information has been reposted by another user). To request the removal of content or information, please email us at hello@kina.co.
12.3 Subject to applicable law, California residents may have certain rights regarding their Personal Information, including the right to know and access the categories and specific pieces of Personal Information we collect, request deletion of Personal Information, request correction of inaccurate Personal Information, receive information regarding the categories of Personal Information disclosed for business purposes, opt out of the sale or sharing of Personal Information where applicable, and limit certain uses and disclosures of Sensitive Personal Information where applicable.
We will not discriminate against individuals for exercising their applicable privacy rights. We may need to verify your identity before processing certain requests, and you may be permitted to use an authorized agent to submit a request on your behalf, subject to applicable verification requirements.
You may exercise applicable privacy rights by contacting us using the information provided in the “Contact Information” section below or through any additional privacy request methods we make available.
13. Changes to this Privacy Policy
